What You Need to Know About Form 177
- This allows companies, after the end of the financial year and payment of corporate profit tax, to request the Tax Authority to redirect the unused amount already paid to the state budget to non-governmental organizations as sponsorship, under the conditions of the law.
- The deadline for submitting the redirection form (Form 177) is the same as the deadline for submitting the annual corporate tax return (Form 101). On the other hand, sponsorship beneficiaries must be registered in the register of associations (United Way Romania has been registered since 08.04.2019), and contracts must be signed with them in accordance with the provisions of the Sponsorship Law.
- The amount redirected through Form 177 represents the unused positive difference from the cap (the lower of 0.75% of turnover or 20% of the corporate tax due), with the responsibility for paying the redirected amount resting with the competent tax authority. The calculation is based on the final financial statements of the previous year, does not require estimations, and poses no risk to the company. If the corporate tax is due at the level of the minimum turnover-based tax, taxpayers cannot opt to redirect the corporate tax determined at the level of the minimum turnover-based tax.
